Who We Are
BAYADA Home Health Care (“BAYADA, “we,” “us,” “our”) is a nonprofit organization providing home-based nursing, rehabilitative, therapeutic, hospice, and other assistive care services to children, adults, and seniors worldwide (“Services”).
BAYADA wants individuals (‘you”, “your”) who visit and use https://www.bayada.com/, https://jobs.bayada.com/en/, and other online platforms displaying this Online Privacy Policy (together, our “Sites”) to be informed about:
- The types of personal information the Company collects
- How information is collected, used, shared, protected, and stored
- Who may have access to your information
- How you can access and update your information.
Your Consent
This Online Privacy Policy covers the personal information we may collect when you visit or use any of our Sites. By using our Sites, you are agreeing to the collection, use, and processing of your personal information collected on our Sites as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use our Sites.
Personal Information We Collect on the Sites
We use the term “personal information” in this Privacy Policy to refer to information that identifies, relates to, describes, or is reasonably capable of being associated or linked, directly or indirectly, to an identifiable individual. Personal information includes information that can be used on its own or combined with other information to identify, contact, or profile an individual.
This Privacy Policy does not cover the protected health information we receive about our clients and prospective clients in connection with our Services. Please see our Health Insurance Portability and Accountability Act (HIPAA) Compliance Information for information about our privacy practices for HIPAA-protected health information.
The personal information covered by this Online Privacy Policy also does not include information that is:
- Publicly available
- Aggregated or de-identified so that it cannot be reasonably used to identify or be associated with you
- Related to current or former employees of BAYADA (unless submitted through our online job application platform).
Personal Information You Provide
We will ask for certain personal information when you:
- Submit an online request for information about Bayada services for yourself or on behalf of another person
- Sign up to receive e-mail or text message communications from us
- Register for an online account
- Make online payments for Services
- Request information about careers or submit an employment application using our online job application platform or through a recruitment platform.
- Make a charitable contribution to Bayada
- Request information about our partner home health care collaboration program.
Depending on the type of request you make, we may ask for the following information:
- Name
- Email address
- Telephone number
- Postal address
- Care recipient’s name and zip code
- Type of service of interest for care recipient
- Payment card information to make an online payment for Services or charitable contribution (using a third-party processor)
- Employment application information (if applicable) including demographic information, education, and work history
- Name of organization you represent and your job title (if applicable).
Information Collected Automatically On Our Sites
We, and those third-party providers we authorize, automatically collect data when you visit our Sites using cookies, pixels, web beacons, and similar internet tracking technologies (collectively, “cookies”). Some cookies are needed for some Site functions to operate. Other cookies are used to collect information about how visitors use our Sites and other websites and social media platforms where we place advertisements.
The data collected using cookies may include the following:
- Time and duration of visits to the Site and account
- Pages viewed and functions used on the Site and account
- IP address or mobile device identifier, which provide general location information
- Unique browser and internet device identification data
- Device type, browser type, and operating system
- Internet browsing and search history
- Internet location from which you navigated to the Site and the location you went to when leaving the Site
- Site activities such as making a payment on the Sites or entering information in a job application
- Interactions with our advertisements placed on other websites and social media platforms.

Information from Other Sources
We may receive contact information and other personal information about current and prospective clients, caregivers, and donors from third parties including referral sources, partners, and other sources including:
- Current and former clients, their families, and caregivers
- Healthcare providers
- Partners in BAYADA’s community-based home health care collaboration programs
- Third-party recruitment platforms, job fairs, and former employers (for prospective caregivers)
- Providers of features for our Sites including payment processing, charitable contribution page for donors, and chat feature
- Data analytics and online advertising services
- Commercial marketing databases, talent and customer resource management services, and data aggregators
- Data management services that enable us to combine information from multiple sources, including information collected on our Sites and information received from third-party sources, to more effectively target our marketing and outreach efforts and evaluate job applications
- Social media (LinkedIn, X, Facebook, YouTube) may provide information you allow to be shared with third parties when you interact with our Sites through the social media platform. For more information, please see the section titled “Third-party Features, Social Media, and Links to Websites.”
How We Use Personal Information
If you provide personal information online relating to our Services, we will use your information to:
- Reply to your questions and fulfill your requests
- Send you news and updates about our Services
- Process payments for Services and charitable contributions (using a third-party processor)
- Send e-mail marketing communications, such as providing you with information about our Services, newsletters, offers, promotions, and surveys unless you opt-out of receiving marketing communications as explained in the section titled “How You Can Control Marketing Communications.”
- Comply with valid legal process and respond to governmental requests.
- For any other purpose with your consent.
If you apply for a caregiver position with BAYADA using our online application platform, we will use the information you provide and received from other sources to:
- Evaluate your application
- Communicate with you during the application process
- Assist with the onboarding process
- Consider your application for alternative positions.
We use cookies and other automated data collection on the Sites to:
- Provide, operate, maintain, improve, and promote the Sites
- Store personal settings and preferences for the Sites
- Retain your login username and password for your online account (managed by an authorized third-party provider)
- Show you personalized ads on other websites and social media, unless you restrict targeted advertising as explained in the section titled, “Cookie Preferences and How to Control Online Data Collection."
- Enhance our marketing efforts by combining data collected via cookies with personal information from other sources
- Track and measure usage of our Sites and user interactions with e-mail communications
- Collect and analyze usage data on our Sites to maintain and improve the Sites
- Detect and address technical issues with our Sites
- Protect our Sites by investigating suspicious activity and unauthorized access, potential fraud or misuse

Sensitive Information
Under limited circumstances we request information for our online forms and features that may be considered “sensitive information” under the laws of some states including:
- Service information requests: Name, zip code, and type of Service of interest
- Payments for Services and Charitable Contributions: credit card and bank transfer information, which is processed and stored by an authorized payment processor
- Job applications: demographic information where relevant and permitted by law or with your consent such as gender, race, ethnic origin, disability, military.
In the event we receive your sensitive information through the Sites, we will use the information only for purposes we reasonably believe you would expect based on the reasons for submitting the information, your interactions with us, or as authorized by law. You may decline to provide sensitive information on the Sites and contact us in other ways. See the section titled, ”How to Contact Us.”
When We May Share or Disclose Personal Information
We will not sell your personal information to anyone or otherwise disclose your personal information in violation of the commitments set forth in this Privacy Policy.
To accomplish the purposes described in this Online Privacy Policy, we may authorize trusted third parties to collect personal information on our behalf and we may disclose or make it accessible to authorized third parties including the following:
- Third-party service providers who perform services on our behalf, subject to confidentiality terms, for technology support, website management, account registration and login authentication, chat feature on the Sites, e-mail marketing, database management, data storage, and other administrative operations.
- Payment processors for online payments
- Google Analytics and other website analytics providers, unless you opt-out as explained in “Cookie Preferences and How to Control Online Data Collection”
- Online advertising services such as GoogleAds, Facebook, and other search engines and social network advertising providers that we authorize to collect information from you on our Sites and facilitate showing online advertisements, including targeted ads, and to you other users who share similar interests or demographic traits, unless you opt-out as explained in “Cookie Preferences and How to Control Online Data Collection."
- Data enhancement services
- Hosting service for our online job application platform
- Third-party employment recruiting services
- E-mail and print marketing services
- Fraud protection services
- Law enforcement and others to comply with legal obligations and defend and enforce legal rights
- Other third parties when we have your consent.
Cookie Preferences and How to Control Online Data Collection
Cookies (including pixels, web beacons, and similar internet tracking technologies) are used for many purposes including to enable some functions to operate on our Sites. Other cookies are used to collect information about how visitors use our Sites and other websites and social media platforms where we may place advertisements or communicate with you.
You can opt-out of having any cookies placed on your browser or device by making a selection using our Cookie Preference Center, ,.or by using your browser settings and other methods as noted below.
Types of cookies we use
The types of cookies we and our analytics and advertising partners may use include the following. If you choose to “opt-out,” we will use only necessary cookies when you visit our Sites.
Necessary cookies are required to for the basic features of the Sites to function, such as log-in and setting your privacy preferences. We do not provide an opt-out method for necessary cookies, although you may set your browser to alert you to or block these cookies. Some parts of the Sites will not work if necessary cookies are blocked. These cookies do not store directly identifying information.
Functional cookies help deliver services requested by the Site visitor such as sharing the content of the Sites on social media platforms, collecting feedback, and other third-party features.
Performance cookies are used to count visits and traffic sources so we can analyze the performance of the Sites. The information these cookies collect is aggregated and does not directly identify individual visitors.
Targeted advertising cookies are placed by third-party ad and social media networks and used to build a profile of your interests based on data collected from your activities over time and across various Internet websites, social media, and other online platforms. Advertising cookies are also used to assess the effectiveness of online ad campaigns by detecting when a user clicks on an ad and is directed to our Sites.
The analytics and advertising cookies we use on our Sites track the type of action a visitor takes on our Sites—such as clinking a link, checking a box or filling out a form. The cookies do not allow the third party servicer to see, for example, which box you checked or the specific information you entered on the form.
Data analytics and digital advertising service providers may also combine cookie-derived data from our Sites with data from other sources to build a more detailed profile of an individual’s preferences, interests and demographic characteristics. Combining information from different sources is intended to help us communicate more effectively with individuals who are likely to be interested in receiving Services or working with us.

The Sites do not respond to “do not track” requests.
How You Can Control Marketing Communications
E-mail Marketing. You can restrict our e-mail marketing communications at any time by:
- Choosing not to submit your information
- Unsubscribing at any time from our e-mail newsletters and other messages
- Contacting us and telling us you want to opt-out of our communications (see “How to Contact Us” below.
It may take up to ten (10) days to process your request to unsubscribe from e-mail marketing messages.
Text messages. If you give us permission to send recurring automated promotional and personalized marketing communications to you by text message, you can withdraw that consent at any time by replying STOP to our text message. It may take up to seven (7) days to process your request to STOP text marketing messages.
If you opt-out of e-mail or text marketing messages, we may still send e-mails to you that involve Services or responses to questions.
Retention of Your Personal Information
We will retain your personal information and other account information as long as we provide Services to you and for a reasonable period to comply with legal obligations, respond to information requests, resolve disputes, and enforce agreements. Information we no longer require for business purposes will be destroyed or de-identified.
Protection of Your Personal Information
BAYADA uses reasonable technical and organizational measures to safeguard your personal information in a manner that is appropriate for the sensitivity of the different types of personal information we collect. Unfortunately, no form of online data storage or transmission is completely secure. We cannot guarantee the security of the personal information you submit to us or that our authorized third parties collect or process for us. We are not responsible for and do not accept liability for unintentional disclosure beyond our reasonable control.
You are responsible for choosing a secure username and password when you set up and use a BAYADA online account or submit a job application. Other steps you can take to make your username and password more secure are:
- Choose a password that you do not use for any other online purpose,
- Avoid telling anyone what your password is, even if you trust them,
- Do not share your password with anyone who claims to work for BAYADA (we will not ask you to do that),
- Change your password from time to time,
- Protect your phone, computer, tablet, or any mobile device to prevent people from using them,
- Log out of your account when you have completed each working session, and
- If you have reason to believe someone has learned what your password is, then:
- Tell us as soon as possible (see “How to Contact Us.”), and
- Change your password.
Third-party Features, Social Media, and Links to Websites
Our Sites may contain links to features, social media, or websites that are owned and operated by third parties. We provide these links for your convenience. Data collection and interactions on any third-party website or service are subject to the third party’s rules and policies, not ours. We have no control over and assume no responsibility for the content, accuracy, or privacy practices of any third-party websites or services. For information about how these third-party services collect and manage your personal information, please refer to their privacy policies.
Third-party Features. Our Sites may use other companies’ applications to power some features, for example, to manage our chat feature, account registration and login authentication system provided by Okta, payment processing portal; charitable contributions portal for donors, and some features on our job application platform including consent to background checks. Some of these third-party features may be branded with the BAYADA logo, even though they are not operated or controlled by us. These third-party applications are able to access your personal information when you use these features.
Social Media. You may choose to interact with our Sites through your social media account (LinkedIn, X, Facebook, YouTube) by clicking on the social media icon on the Sites, following us on a social media network, or posting a comment to one of our pages. The social media network may send us the information you make available to third parties through the settings on your social media account. This information may include your profile, gender, username, user ID associated with your social media account, age range, language, and other information you permit the social network to share with third parties. We use this information to enable you to use interactive functionalities between our Site and the social media network and allow is to send messages to your social media account about BAYADA.
Links to Third-Party Sites. Our Sites may include links to websites operated by third parties that have information we think may be of interest to you. If you click on a third-party link, you will be directed away from our Site to that third-party website and any information you provide to that third party website or is collected from your usage, will be available to the third-party operator. The third-party website operator may collect your IP address or device identifier and other internet browsing data and may place a cookie on your browser to enable their features to function and track your usage of their website.
Children’s Personal Information
Our Sites are not directed toward children under the age of thirteen (13) years. We do not knowingly collect on our Sites any personal information about children under the age of 13 without verifiable consent from a parent or legal guardian. If you have reason to believe that a child under the age of 13 has provided personal information to us through the Sites, please contact us. See “How to Contact Us” below.
Processing of Personal Information in the United States
This Online Privacy Policy applies to personal information collected in the United States under United States laws and regulations. If you reside or are located in a different country, the data protection laws of that country may differ from the laws of the United States in the ways your personal information is protected. We want you to understand that when you provide your personal information to us, or engage in a transaction with us, you are giving your consent to: (1) the transfer of your personal information from your country of residence to the United States; and (2) the processing of your information in accordance with the laws of the United States and the guidelines of this Online Privacy Policy.

Changes to this Privacy Policy
This Online Privacy Policy is current as of the Effective Date set forth above. We may change this Policy from time to time to reflect business and legal changes, so please be sure to check back periodically. If we change the terms of this Privacy Policy, we will post the revised Online Privacy Policy on the Sites and provide other notification as required by applicable law.
Any changes will become effective upon the posting of the revised Online Privacy Policy on the Site. By continuing to use the Sites following such changes, you will be deemed to have agreed to such changes. If you do not agree with any or all of the terms of our Online Privacy Policy as in effect at any time, please do not continue to use the Sites.
